Purpose and Intent
It is the intent of this Ordinance to promote and protect the public health, safety, and welfare of the citizens of San Diego by limiting ownership of single-family homes through the requirements set forth in this Ordinance and by balancing the need to preserve the obtainability of those unique qualities of life gained only through home ownership with the economic prosperity available through private property. This Ordinance is enacted to ensure that the sale of single-family homes is appropriately regulated.
Definitions
For the purpose of this Ordinance, the following definitions shall apply and appear in the text in italicized letters:
Dwelling unit has the same meaning as in Municipal Code section 113.0103.
Entity
Individual
Occupancy means the use or possession, or the right to the use or possession, of a dwelling unit for dwelling, lodging, or sleeping purposes.
Ownership means to have any interest in a residence.
Primary residence means the dwelling unit in which an individual resides at least six months of the year. An individual can only have one primary residence.
Rent means the total consideration charged for residential occupancy per month.
Short-term residential occupancy means the occupancy of a dwelling unit or part thereof for less than one month.
Limits of Single-Family Home Ownership
It is unlawful for any person to purchase the rights to a single-family home except as provided in this Ordinance.
Single-Family Home Ownership Regulated
(a) General Rules Applicable to All Sales.
(1) No individual or entity shall be permitted to buy or own any single-family home where that individual or entity is in possession of two (2) single-family homes.
(2) Where an individual or entity is in possession of more than two (2) single-family homes at the time in which this ordinance passes, those individuals or entities will not be in violation of this ordinance as it relates to those homes in their possession prior to the passing of this ordinance.
(3) Violation of these rules will subject the buyer or owner to liability as outlined in paragraph (b).
Liability for Violation of this Ordinance
(a) In addition to any penalties and remedies provided by law, either common-law or statute, and any other bases for regulatory action provided by law, an individual or entity found to have obtained possession of a single-family home while already in the possession of two (2) or more single-family homes shall be found liable and subject to the following penalties and actions.
